Our investment service and funds team has assisted a number of fund custodians authorised in Malta to obtain their Category 4 licence and drafted their operational manuals and template documentation. The team also has extensive experience in advising on global custody and settlement related issues as well as drafting and negotiating custody and sub-custody agreements on both sides of the negotiation table.
The firm was also heavily involved in the drafting of the Investment Services Act (Control of Assets) Regulations which is the cornerstone piece of legislation under Maltese law regarding custody of assets, custodian’s liability and the statutory segregation of assets under custody. It also regularly issues the so called US Rule 17-f5 sub-custody opinions on Maltese law and the protection afforded to custody assets held with Maltese sub-custodians.
