The country report deals with a recent judgment delivered by the Court of Appeal (Malta) on 29 April 2019 on a public procurement challenge. This judgment upheld an appeal from an aggrieved bidder who challenged the legality of a tender on the basis that the information disclosed about a specific tender requirement was not sufficient for the unsuccessful bidders to compete on an equal level playing field with one of the bidders who was an incumbent on a neighbouring market.
