The Aircraft Registration Act, 2010 revamped Maltese laws relating to aviation, particularly through the accession and ratification by Malta of the Convention on International Interests in Mobile Equipment, 2001 (the “Cape Town Convention”) and its Protocol. The Aircraft Registration Act, however, is not limited in scope to the registration of aircraft, but rather adopts a creditor-friendly body of laws by allowing for the possibility of owners granting mortgages over aircraft, allowing for international interests to be registered over aircraft and engines (prevailing over Maltese-registered mortgages), Irrevocable De-Registration and Export Request Authorisations (IDERAs) to be filed, and for owner and lessor interests to be registered in the National Aircraft Register. The Aircraft Registration Act also legislatively implemented “Alternative A” to the Cape Town Convention.
